By accessing this page you can read the current version of these provisions. sc AltConcept srl cannot be held responsible for any errors that may occur on the site for any reason, including due to changes, settings, upgrades, etc.

2. Price

The prices of the products on the website www.foxenia.ro are prices with 21% VAT. All products are new and unused and are delivered with a tax invoice. At the time of invoicing, the price is rounded to the nearest whole value. All products returned from customers are destroyed by recycling if they do not meet the initial quality conditions.

3. Definitions

The foxenia.ro website is managed by sc AltConcept srl, CIF RO18586221, with registered office in Belcesti commune, Munteni 4 street, Iași county, registered at the Trade Register Office with no. J22/972/2006, account at BRD Ag. Nicolina, RO58BRDE240SV05390062400, hereinafter referred to as the Supplier. The natural or legal person who orders and purchases products through the foxenia.ro website is hereinafter referred to as the Consumer. The web address: foxenia.ro will be hereinafter referred to as the foxenia.ro website. The images, texts, prices, technical data, and other information found on the foxenia.ro website will be hereinafter referred to as Information. Copyright: Any Information contained on the foxenia.ro website is the property of the Supplier and is subject to the Law on Copyright and Related Rights. The use of any of the elements listed above without the consent of the Supplier is punishable in accordance with the legislation in force. The information may only be used with the written consent of the Supplier.

4. Electronic communications

By using the foxenia.ro website, purchasing products, sending emails to/from the foxenia.ro website, communication is carried out electronically, it being considered that the user consents to receiving notifications from foxenia.ro electronically, including one of the communications by email, sms or through the announcements on the website. Any request placed through the foxenia.ro website becomes an order only upon our confirmation and then has contractual value.

5. Subscription to commercial communications / Subscription to news / Subscription to newsletter

The purposes of distributing commercial communications are:

1. placing commercial offers on discounted products (for visitors or subscribed customers);
2. announcements regarding newly released products on the site (for visitors or subscribed customers);
3. requesting the completion of the order with products in an abandoned cart following a visit (only for visitors or customers logged in to the account);

sc AltConcept srl guarantees the user limited access, for personal use, to this site and does not grant the user the right to download or modify the site in whole or in part, to reproduce the site in whole or in part, to copy, sell/resell or exploit the site in any other manner, for commercial purposes or contrary to the interests of our company, without the written consent of AltConcept srl. C. Policy on the protection of individuals with regard to the processing of personal data and the free movement of such data – GDPR

sc AltConcept srl guarantees the security and confidentiality of data collected through the foxenia.ro website. The personal data entered by the Consumer will be used only for the stated purpose of this website. The information in the order request form is necessary to send you confirmation of orders, to deliver the products ordered by you or for return, in case of withdrawal, delivered by courier, or to request comments on the website (e-mail and first name only). At the time of receipt of the package by you, they are written on the fiscal invoice that accompanies the product. Also, at the time of delivery of the order by Fan Courier Express srl , the name and surname, telephone number and delivery address will be used for the transport document (awb). We do not provide your personal data to any other third party. However, your personal data may be transmitted to the authorities entitled to verify commercial transactions or to other authorities entitled to carry out any justified checks based on the legislation in force. Sc AltConcept srl, if it finds a breach of personal data security, will notify this to ANSPDCP within 72 hours from the date on which it became aware of it. The processing of personal data is necessary to fulfill only the contractual terms provided by the online merchant, or for the steps preceding the conclusion of a contract with an online merchant.

18. Legislation regarding the processing of personal data – GDPR

The processing of your personal data is necessary both for the fulfillment of the contractual terms concluded between you and the processor of personal data, as well as for the steps preceding the conclusion of a contract between you and the processor, in accordance with Article 6 paragraph 1 subparagraph b) Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "regulation").

19. Purpose of processing personal data

The purpose of processing your personal data is to initiate or conclude a contract between you and the processor. The processor is not automatically granted free decision-making pursuant to Article 22 ⁽¹⁾ of Regulation 2016/679.

20. Personal data retention period

Personal data is kept by the data processor for a period of 10 years and is archived according to accounting law.

21. Third parties involved in obtaining personal data

Other parties involved in obtaining personal data will be both courier companies, or any other persons involved in the delivery of the purchased goods, as well as parties involved in the successful completion of payments related to the purchase contract. The Data Processor does not intend to transmit your personal data to a third country (outside the EU) or to international organizations.

22. Rights of the personal data holder

In accordance with the terms and conditions set out in the Regulation, you have the right:

You have the right to receive clear, transparent, understandable and easily accessible information about how we use your data and your legal rights.

• Right of access 3 .

You have the right to access the personal data we hold about you. The first provision of information will be made without any charge. If you require further copies of information already provided, we may charge a reasonable fee taking into account the administrative costs of providing the information. Requests that are manifestly unfounded, excessive or repeated may not receive a response.

• Right to rectification 4 .

You have the right to request that your data be rectified if it is inaccurate or outdated and/or to complete it if it is incomplete. To do this, please contact us using the information below. If you have an account, it may be easier to correct your own data via the “My Account” function.

You have the right to move, copy or transfer the data you are interested in from our database to another. This only applies to data that you have provided, when the processing is based on your consent or on the basis of a contract and is implemented by automated means.

You are not obliged to provide us with your personal data. However, providing your personal data is a necessary requirement for the conclusion and execution of the Contract. Without providing your personal data, both the conclusion of a contract and its fulfillment by the Supplier cannot be achieved.

D. Partners

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services to you. The information you submit through the Services will be transmitted and shared with Shopify, as well as with third parties that may be located in countries other than the one in which you reside, in order to provide and improve the Services to you. In addition, to help us protect, grow, and improve our business, we use certain enhanced Shopify features that incorporate data and information obtained from your interactions with our Store, as well as with other merchants and Shopify. To provide these enhanced features, Shopify may use the personal information collected about your interactions with our Store, as well as with other merchants and Shopify. E. Commercial warranty 9 of the products

• The products 10 sold 11 by foxenia.ro have a legal guarantee of conformity.
• The legal guarantee of conformity applies only for lack of conformity, that is, if the products are found at the time of their delivery to the consumer 12 , in one or more of the following situations:
  • do not correspond to the description made by the seller and do not have the same qualities as the products that the seller presented to the consumer as a sample or model;
  • they do not correspond to any specific purpose requested by the consumer, a purpose made known to the seller and accepted by him upon conclusion of the sales contract;
  • they do not correspond to the purposes for which products of the same type are normally used;
  • being of the same type, does not present normal quality parameters and performances, which the consumer can reasonably expect, given the nature of the product and the public statements regarding its specific characteristics, made by the seller, the manufacturer or its representative, in particular through advertising or by inscription on the product label.
• If you have any problems with an order, please send a request for conciliation to foxenia.land[at]gmail.com. We will respond within 24-48 hours.
• AltConcept srl guarantees that the delivered products correspond to the description published on foxenia.ro, especially with regard to the material composition and dimensions.
• The product dimensions in the online description are understood to be approximate dimensions and are tolerated by +/-5%. The declared dimensions are measured before filling with polyester down.
• Although we have taken great care to ensure the accuracy of the colors presented on the site, please be aware that due to monitor resolution, lighting during the photo shoot, photo processing software (if used) and other factors, it is almost impossible to reproduce the actual color of the product with 100% accuracy.
• The product warranty is 30 days and refers to hidden defects (material or workmanship). The warranty is granted only if the product is used for the purpose for which it was created, according to the description on the site, namely for the comfort of the human body in the household, by people of normal weight and height. We assume no liability and the warranty is not granted if the product has been used as a treatment for medical conditions or if it has been associated with any kind of treatment, you have changed the destination of the product, you have made any kind of modifications to the product, you have not respected the conditions of use or maintenance.

23. Product Disclaimer

• sc AltConcept srl does not guarantee the availability of all displayed products in stock, which is why we will not be able to partially or fully deliver a certain order if certain products no longer appear in our current offer or are not available for other reasons (temporary lack of stock, out of stock, etc.).
• The Consumer will be notified as soon as possible of the unavailability of the requested products. The maximum value of the obligations of sc AltConcept srl, towards any Consumer, in the event of non-delivery of the products, is the value of the amount collected by sc AltConcept srl from the respective Consumer, the amount which will be returned to him within a maximum of 14 days.
• The products (when applicable) are accompanied by Certificates of Quality and Conformity from manufacturers and importers and instructions for use.
• Please notify us of any complaint you may have within 48 hours of receiving the products (date of the refund receipt), which will be forwarded to the manufacturer/importer of the respective products for resolution.
• sc AltConcept srl does not guarantee and cannot be held responsible if the purchased products are not used for the purpose for which they were designed/manufactured.
• Our products are NOT medical devices as defined by the National Agency for Medicines and Medical Devices.
• In case of any medical condition, you should consult a specialist doctor. The specialist doctor can make recommendations or prescribe treatments for the diseases you are suffering from.
• Also, our products are not intended for people with special needs or people with obesity or severe obesity or those with below average weight.
• The companies, products or services mentioned in the articles published on the site are registered trademarks of their respective companies. The use of any registered trademark name is made for the purpose of analysis only and does not constitute an advertisement for the respective company.
• We will not be liable to any person or company that uses or relies on any information or opinions contained on this site. We will also not be liable for: any damage (direct, indirect, incidental or otherwise) resulting from the use or inability to use the information presented on the site, any errors or omissions in the content that may lead to any loss.

F. Transportation (when/with whom/how much does it cost)

• Deliveries are made only after we contact you by phone or in writing via e-mail or SMS. Please confirm your acceptance of the delivery time, for example, or details that were overlooked when sending the order request. If our request is not answered within 24-48 hours, the order request is deleted/cancelled.
• Deliveries are made only to permanent addresses (home or at the company where you work). That is why it is good to also follow your e-mail. There are situations where the delivery address is not complete or the phone number is wrong, we will request the details by e-mail and vice versa.
• The products are unique and are delivered only based on online ordering and cash on delivery payment to the courier's collection account or online payment by card.
• The execution time of foxenia.ro products is generally 1-3 days from the moment of order confirmation via SMS or email. Products in suppliers' stocks with the label "In supplier stock" are delivered within 3-5 days from our confirmation via SMS or email.
• We use the express couriers FAN Courier Express srl and DPD Romania only in Romania. The shipping/transportation term is on average 1-2 days. The couriers' delivery hours are 9°°-17°° from Monday to Friday.
• The shipping cost is 19 lei as it appears in your online order, only in areas covered by Fan Courier Express . The site does not calculate shipping for areas not covered by Fan Courier srl.
• If requested by the customer, deliveries can also be made on Saturdays but are charged by Fan Courier an additional 7.14 lei (6 lei+VAT). In this case, the shipping becomes 19+7.14=26 lei. DPD Romania does not make deliveries on Saturdays.
• Only online orders placed on the website will be processed, with delivery to addresses in Romania and phone numbers with the +40 prefix.

24. Delivery and payment methods

You can pay for products in 3 ways:

• Cash on delivery, you pay cash to the FAN Courier agent upon receipt of the products. You receive the tax invoice on/in the package and the receipt from the courier for the entire value of the package. We do not deliver with cash on delivery through DPD Romania, only products already paid for by bank card.
• 100% in advance, via Libra Bank payment link, according to our offer sent by email for customized or standard products.
• Online payment by bank card via the Librapay service. Bank card data (card number, expiration date, etc.) are not transferred or stored on our website. Payment security is maximum and is ensured exclusively through the Libra Internet Bank system.
• Other forms of payment, such as payment by vouchers, cards similar to vouchers or Materna vouchers, are not accepted. We do not collaborate with any company/institution issuing vouchers, cards, vouchers similar to these.

25. Free shipping

• Free shipping refers to product orders of at least 450 lei only within the courier's coverage area.
• For locations not within Fan Courier's coverage area, the delivery cost will be communicated by phone/SMS/email. Our website does not calculate this cost.
• The additional cost for external kilometers is paid by the customer.
• The list of locations covered by Fan Courier (without additional costs for external kilometers) can be found here . Please consult it before ordering.

26. Delivery times

• Foxenia.ro products are unique and are made to order only. The execution time for Foxenia.ro products is normally between 2÷5 working days, from the moment of our confirmation by SMS or e-mail. In this way, your request becomes an order.
• Products in suppliers' stocks. Typically, these are delivered within 5-7 business days from order confirmation. When purchasing them together with foxenia.ro products, delivery times may increase beyond the proposal in the paragraph above.
• There is sometimes a possibility that these deadlines may be slightly exceeded during certain periods of the year (December is generally busy, around Easter, November on the occasion of Black Friday) or due to the large number of orders received. In these special conditions, sc AltConcept srl reserves the right to extend the delivery time by notifying the customer of the respective delay.
• Non-working days (including public holidays) are: January 1-3, 5-6, 24; April 30; May 1-2; June 1, 21; August 15; November 30; December 1, 24-31.
• We strive to keep execution times as short as possible. To these times is added the shipping by courier.
• The consumer must confirm or deny the new proposed delivery date.

Note: For Romania, courier delivery schedules as communicated on the websites of the carriers Fan Courier , Cargus and DPD Romania may influence delivery times during certain periods of the year.

28. Cancellation of order or order request

An order placed on the foxenia.ro website can be canceled by the customer in writing, by e-mail or SMS to the addresses in Useful Phone Numbers . The cancellation of the order is valid only if it is communicated no later than the next day at 12°°, the date of the SMS or e-mail, and the product has not left us. After this date, the requirements in chapter G. Return Policy apply. You cannot cancel an order that is being delivered to the recipient, so that you have not received it.

Other valid reasons for canceling the order request or order are:

• the customer does not respond to SMS or phone or email at the time of shipping the products and we do not have confirmation that the products can still be received;
• the delivery times requested by the customer are shorter than the minimum delivery times proposed by us, consequently they cannot be achieved;
• the delivery data (telephone, address, e-mail...) is incomplete, wrong or false;
• customer located far from Fan Courier's coverage area (over 20Km) or the incidence of transport to the destination exceeds 10% of the value of the products in the order request. It is possible to request advance payment for the product and/or updated transport;
• pending orders, unpaid online, although the customer checked online payment with a bank card but did not complete the payment, so we do not have confirmation of the payment from Libra Bank;
• products missing/unavailable in stock or products with zero prices/incorrect price;
• failure to comply with the requirements in the Return Policy chapter will result in the cancellation of future orders/deliveries;
• The consumer who does not pick up/receive the ordered products and does not pay for the return shipping will be refused, in the future, for other deliveries.
• violation or attempted violation of any requirements of this document which could generate unjustified additional costs for AltConcept srl.

29. Discount coupons

Discount coupons apply to products that are not already on sale and for a limited period of time.

1. Discount coupons apply to products that total at least 95 lei in the cart.
2. Discount coupons do NOT apply to products in the Discount or Outlet categories and subcategories.
3. The discount is applied after adding the products to the shopping cart. The discount through coupons is not automatic and remains at the discretion of the customer whether to apply it or not.
4. The discount period, if any, is communicated by subscribing to the newsletter.
5. Coupons cannot be combined with each other or with existing discounts or free shipping.

G. Refunds and Returns Policy

Foxenia.ro wants to offer very good quality products using raw materials from renowned Romanian and European manufacturers in the field. However, sometimes the Consumer wants to return for objective or subjective reasons. The Consumer can return an order at any time, in whole or in part, under the conditions provided by law.

If you wish to withdraw from the contract, you must bear in mind that the return is not free of charge. “You will have to bear the direct cost of returning the products” ¹³ . A cost estimate can be found at https://www.fancourier.ro/estimare-cost/ on the FanCourier website.

30. Legal return period

"The consumer has a period of 14 calendar days to withdraw from a distance contract [...], without having to justify the decision to withdraw.

The maximum return period is 14 calendar days 14 measured from the date of receipt of the product (taking possession) until sending proof that the product has left you and was shipped to us by express courier.

31. Decrease in value of returned goods 15

Since, in the case of distance sales, the Consumer does not have the possibility to see the goods before the conclusion of the contract, he has the right to withdraw. For the same reason, the Consumer is allowed to test (not use) and check the goods he has purchased to the extent necessary to establish the nature, characteristics and functioning of the goods.

You are responsible for any diminished value of the goods resulting from handling other than that which is necessary to establish the nature, qualities and functioning of the goods 16 .

In order to establish the nature, characteristics and functioning of the goods, the consumer must handle and inspect them in the same way as he would be allowed to do so in a physical store 17 . For example: the consumer only needs to try on an item of clothing, not wear it on various occasions, or, in our case, the consumer only needs to try on the pillow, not sleep on it. Therefore, during the withdrawal period, the consumer must handle and inspect the goods with due care.

The ACCEPTED manipulations for determining the nature, quality and functioning of the goods are:

1. unpacking without destroying/damaging the original packaging. As a result, when you return a product, you are obliged to return it with the original undamaged packaging, the product being protected by the original plastic bag and placed in the cardboard box (without labels stuck on it, without cuts, tears, etc.) and together with all items received as a gift.
2. visual, tactile and olfactory inspection (when the provisions below are not violated) of the products;
3. feeling, fitting, measuring, bending, kneading by hand, laying on the bed;
4. covering or uncovering cushions with outer covers without damage;
5. testing the hardness or elasticity of pillows;

If a consumer exercises his right of withdrawal after having used/used/carried the goods to an extent that exceeds the limit necessary to establish the nature, characteristics and functioning of the goods, the consumer is liable for any diminished value of the goods.

UNACCEPTABLE actions that lead to a decrease in the value of the returned product or the loss of the right of withdrawal:

1. using/wearing/utilizing the products in any way;
2. tearing or soiling of labels;
3. breakage or damage to the original packaging (the original packaging is an integral part of the product);
4. scratching, soiling, staining, impregnation of products with external substances;
5. unsealing cleaning products, cosmetics, personal care products, products for children and newborns or underwear.
6. the products show traces of makeup, creams, grease, deodorant, stains, breakage, broken threads, cuts, human or animal hair, tears, blood;
7. the outer or inner covers have been washed, ironed, or perfumed or show signs of wear or creasing from wear/use;
8. the consumer has had the product in possession for more than 14 calendar days;

The value of used / worn / slept in products ... is accepted for return only after they have been brought into conformity, involving the costs of sanitation, beautification, repair, sewing, overcasting, replacement of any damaged parts and bringing to a commercial form for resale as a Reconditioned product. The final value is established according to the value of the components to be replaced and the reconditioning labor or the difference between the initial value of the new product and the resale value of the used product.

Any change in the initial condition of the products or damage to their original packaging that makes it impossible to sell the product as new automatically leads to the application of a return procedure subject to fees to restore the products to the initial condition in which they were delivered.

The reduction is applied as a percentage between 10%-90% of the initial value of the product. The reduction fee will be communicated to the customer upon receipt of the modified products with a report of the differences.

You can return it if you accompany the product with the tax invoice or its copy, along with the instructions for use and the declaration of conformity and warranty in the original packaging (cardboard box and plastic bag).

If the products in whole or in part cannot be brought into conformity and cannot be resold, they will not be refunded. They will remain in your custody for 14 days after which they will be disposed of by recycling.

32. Product replacement

In case of requesting the replacement of the product with an identical one, or with a different model, it must have an equal or greater value than the returned product. The product must comply with the conditions of compliance with G. Return Policy.

The return for the replacement of the model/color, only if the product is in its original condition, is accepted only once and for a single product. If the replacement is requested by the customer, the customer pays the return shipping of the product and the refund.

If the replacement is due to us, the return shipping costs of the product and the refund will be borne by us.

33. Refund of the value of the returned product

Returned products are received into management based on a Report of differences.

Confirmation of receipt of the return is sent in writing by email within 14 days of receiving and checking the package.

Products that remain saleable will be refunded at the reduced or full value calculated by the Minutes.

The refund of the product value is made by bank transfer to the IBAN account indicated on the return form . In this case, we need the following information: Account holder name, account IBAN and bank.

The refund period is a maximum of 14 days from the date the product enters our possession.

The consumer who does not pick up/receive the ordered products and does not pay for the round-trip shipping will be refused, in the future, for other deliveries.

The consumer who received the product, as ordered, returned it in violation of our Terms and Conditions , and returns with a new order, will be refused, in the future, for other deliveries.

Returns are not accepted through the Romanian Post, but only through courier companies such as Fan Courier or DPD Romania, or through another courier company of your choice, as long as you pay for the shipping according to legal provisions.

Attention! Courier service costs are not refundable. If you wish to return an order in whole or in part, and the initial delivery cost of the order was borne by us (for orders over 250 lei), the delivery fees of the initial order will be deducted from the returned value.

DON'T FORGET: Make sure the product you want to return meets the return conditions .

34. According to GEO 34/2014 there are exceptions to the right of withdrawal

“They are exempt from the right of withdrawal provided for in art. 9-16 with regard to distance contracts” […] “c) products made according to the specifications presented by the consumer or clearly personalized”. Please note that the specifications refer to: material color, type of material, dimensions, addition/removal of applications, etc. and are transmitted in writing, by e-mail, or in the order request. Products made to order are not mass-produced and are executed at the express request of the customer, which makes it impossible to return them. We do not assume responsibility for information erroneously transmitted by the customer regarding the specifications of the personalized product. e) sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer.

35. Product return form

To communicate your decision to withdraw, to return our products you must complete the Return Form.

By completing the form, you inform us of your decision, which you must implement (to send us the product(s) back) no later than 14 days after purchase and provide us with proof of sending with the AWB number.

37. Fraud

Any attempt to access the personal data of another Consumer or to modify the content of the foxenia.ro website will be considered an attempt to defraud the foxenia.ro website and will result in legal action for that attempt.

38. Copyright

The entire content of the site: images, texts, symbols, Web graphics elements, scripts, programs, logos, databases, is the property of sc AltConcept srl and its suppliers and is protected by copyright law. The use without the consent of Altconcept srl, of any of the elements listed above is punishable according to the laws in force. You, as a user, fully agree with the above.

39. Litigation

Any dispute arising between Consumers and the Supplier will be resolved amicably. If the conflict is not resolved amicably, the Romanian courts in the city of Iași have jurisdiction.
